Alcudia Town Hall has denied a building permit to legalise the construction of the Botel Alcudiamar. The environmentalists GOB have welcomed the town hall's decision, which definitively denies the permit to legalise construction of the hotel in the marina, which is within the port's public domain.
GOB say the decision confirms arguments they have made for years - that construction by Alcudiamar S.L. was illegal and was done without the necessary permits. Two buildings do not have a permitted hotel use, according to municipal technical and legal reports.
The environmentalists add that the tourism permit the company had sought to use was declared null and void in 2022 by a final ruling of the Balearic High Court. "Renovations and expansions lacked the required authorisation from the Balearic Ports Authority, despite requests from Alcudia Town Hall."
GOB note they have maintained a lawsuit for the past five years against a 2020 municipal resolution that sought to authorise hotel use of the botel, a case that is still pending judgment. "The latest decision by the town hall reinforces GOB's long-standing legal and environmental position, which has consistently denounced the impossibility of authorising hotel use on public port land outside the exceptional circumstances provided for by state legislation."
They are demanding the immediate execution of the court ruling ordering the closure of the illegal tourist activity, the complete restoration of the affected port area, and an end to attempts to legalise hotel uses, which are contrary to port regulations, the Coasts Law, and the environmental values of the Bay of Alcudia.
"We will continue to monitor the situation to ensure that the port of Alcudia does not become an area for real estate speculation and that the authorities guarantee strict compliance with the law regarding public land."
